Affirmations

Terms of Use

The terms that apply to Affirmations and its related services.

Effective

On this page

Please read these Terms before agreeing. For users in the United States, Section 12 provides for binding individual arbitration and a class-action and jury-trial waiver for covered disputes. You can opt out within 30 days. Mandatory consumer rights and the exceptions in that section remain available.

1. Your agreement with us

These Terms of Use (“Terms”) govern the Affirmations app, its related services, and theaffirmations.app (the “Services”), provided by Tuvo Labs Limited Co, an Arizona limited liability company (“we,” “us,” or “our”). They apply when you accept them through a process that presents these Terms and asks for your agreement. If you do not agree, do not use the Services. Simply reading these pages does not itself constitute acceptance of the arbitration agreement.

Our Privacy Policy explains how information is handled. Acceptance of these Terms does not replace any separate consent required by privacy law.

2. Eligibility and personal use

You must be at least 13, meet any higher minimum age required by applicable law, and satisfy the relevant store’s requirements. If you have not reached the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms and authorize your use and purchases.

You are responsible for keeping your device and store account secure and for activity you authorize. The app does not require an Affirmations account. Features, supported devices, and availability can differ by platform, region, and version.

3. General well-being, not medical care

Affirmations provides content and tools for personal reflection, relaxation, and general well-being. The Services do not provide medical or mental-health advice, diagnosis, treatment, therapy, or a professional relationship. Content about health, emotions, recovery, or similar topics is general information, not a personalized clinical recommendation.

Do not use the Services instead of qualified professional care or delay seeking care because of app content. We do not promise a particular emotional, physical, financial, or other result. Stop an exercise if it causes distress or discomfort, and do not use audio or relaxation exercises when doing so would make an activity unsafe.

The Services and support inbox are not emergency services. If you need urgent help or are in immediate danger, contact local emergency services.

4. License, content, and acceptable use

Subject to these Terms and the applicable store license, we permit you to use the Services for your personal, noncommercial use. The app, its library, artwork, recordings, design, and software are owned by us or our licensors and are protected by applicable intellectual-property laws. No ownership is transferred to you.

You may use the app’s sharing tools to share individual affirmation cards for personal, noncommercial purposes. That permission does not authorize extracting or republishing the library, reselling our recordings or artwork, or distributing the app itself.

You must not misuse the Services, including by:

  • Breaking the law, infringing another person’s rights, or distributing unlawful material.
  • Bypassing payment or access controls, interfering with security, distributing malicious code, or seeking unauthorized access.
  • Scraping, bulk downloading, redistributing, or commercially exploiting our content, including using it to train a model or build a competing content library, without permission.
  • Reverse engineering or modifying the Services, except to the extent applicable law expressly permits it.

These restrictions do not remove rights that cannot lawfully be restricted, including applicable exceptions to intellectual-property rights.

5. Your content and saved data

You retain the rights you have in affirmations and other material you create. You are responsible for having the right to use and share that material. You authorize only the processing, display, storage, and transmission necessary to provide the features you choose, such as saving a personal affirmation on your device or exporting an image. These Terms do not give us a right to publish your private writing for our marketing.

Personal content and progress are stored locally, without an Affirmations account-based backup or sync service. Keep independent copies of material that matters to you. Uninstalling, clearing app data, losing a device, or restoring it can affect saved information. We cannot promise to recover local-only data. Restoring a purchase restores eligible access, not your saved writing or history.

6. Subscriptions, trials, and payments

Some features require a paid purchase or subscription. The offer shown before purchase identifies the price, billing period, included features, and any trial or introductory conditions. Do not rely on an example price or an offer shown to someone else. Availability and trial eligibility may vary.

Subscriptions renew automatically unless you cancel through the store before the applicable renewal deadline. The App Store or Google Play Store processes payment using your store account. A free or discounted trial converts to the disclosed paid subscription unless canceled in time. For an App Store trial, cancel at least 24 hours before it ends; follow the deadline and instructions shown by your store for other offers.

You can manage or cancel your subscription in the relevant store’s subscription settings. Deleting the app, deleting local data, or emailing us does not cancel billing. Cancellation normally takes effect at the end of the paid period; trial access and any earlier termination follow the store’s rules and applicable law.

Refund requests follow the purchasing store’s process and applicable law. Nothing here excludes mandatory rights to a refund, withdrawal, repair, or other remedy. Any legally required consent to immediate delivery of digital content or acknowledgment about withdrawal rights must be obtained at the relevant purchase step; these Terms alone do not waive those rights.

We may change future offers or prices. A change affecting an existing subscription will follow the store’s notice and consent requirements and applicable law. Existing paid-period rights will be respected. Restore eligible purchases using the same store account. Purchases are not automatically transferable between stores.

See subscription support for cancellation, restoration, and refund instructions.

7. Availability and changes to the Services

We may maintain, update, or change the Services, including content and supported features. We will give notice when required by law and will respect rights relating to purchases already made. If a material change or discontinuation affects a paid service, any required cancellation, refund, or other remedy remains available.

Internet access, store systems, device settings, operating-system limits, and third-party services can affect availability. We do not guarantee uninterrupted access, exact notification or widget timing, or compatibility with every device. You are responsible for ordinary internet and device costs.

8. App stores and external services

Store purchases and use of store services are subject to the applicable App Store or Google Play Store terms. For an app obtained through the App Store, the App Store standard end-user license agreement applies to the software license unless a valid custom license is separately provided. These Terms supplement the applicable store license for our Services and do not override mandatory store terms or that license’s controlling provisions.

We provide support for Affirmations. Store operators handle their own billing and store services. When you open an external link or share content to another service, its own terms and privacy practices apply. We do not control external services or guarantee their continued availability.

You must comply with applicable export, sanctions, and third-party service requirements when using the Services.

9. Disclaimers and consumer rights

To the extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement to the extent those warranties may lawfully be disclaimed. We do not guarantee that the Services will be error-free or meet every expectation.

Nothing in these Terms excludes guarantees, warranties, or remedies that applicable law does not allow us to exclude. If you are a consumer, you retain mandatory protections in your place of residence, including rights relating to digital content and services.

10. Limits on liability

To the maximum extent permitted by law, we and our officers, employees, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or lost profits, revenue, or data, arising from or relating to the Services or these Terms, even if advised that such losses were possible.

To the maximum extent permitted by law, our total aggregate liability for claims arising from or relating to the Services or these Terms is limited to the greater of US $100 or the amount you paid us for the Services in the 12 months before the event giving rise to the claim.

These exclusions and limits do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence where liability cannot be limited, or any liability or remedy that applicable law does not permit us to exclude or limit. They do not restrict mandatory consumer rights, including recovery for losses where required by law.

11. Responsibility for third-party claims

To the extent permitted by law, you agree to reimburse us for reasonable losses and costs arising from a third party’s claim caused by your unlawful conduct, your infringement of that party’s rights, or your intentional or materially negligent misuse of the Services in breach of these Terms. This obligation does not cover losses caused by our own breach, negligence, or misconduct.

We will give you prompt notice of such a claim and a reasonable opportunity to participate in its defense. We will not agree to a settlement imposing a nonmonetary obligation or admission on you without your consent. This section applies only to the extent consistent with mandatory consumer law.

12. U.S. dispute resolution and arbitration

Who this section covers

This arbitration agreement applies only if you reside in the United States when you accept these Terms, only to the extent permitted by law, and only if you do not opt out as described below. It covers disputes between you and us arising from the Services or these Terms, except the matters expressly excluded below. It does not apply to a dispute already notified in writing before you accepted it.

FOR COVERED DISPUTES, YOU AND WE AGREE TO INDIVIDUAL, BINDING ARBITRATION IN PLACE OF A COURT TRIAL. YOU AND WE WAIVE A JURY TRIAL AND PARTICIPATION IN A CLASS OR REPRESENTATIVE PROCEEDING FOR THOSE DISPUTES.

First, try to resolve the dispute

Before starting arbitration, send a notice to support@theaffirmations.app with the subject “Affirmations dispute notice.” Include your name, a way to contact you, a description of the dispute, and the relief requested. We will send any notice to an email or other contact address you have provided. Both sides will try in good faith to resolve the dispute for 30 days after receipt. Either side may proceed if the other does not participate.

Applicable limitation periods are paused, to the extent permitted by law, during this informal period and the arbitrator-selection process. This process does not prevent a timely small-claims filing, urgent interim relief, or a report to a regulator.

A neutral arbitrator and fair procedure

The Federal Arbitration Act governs this arbitration agreement. One independent, impartial arbitrator will hear the dispute. Within 30 days after either side requests arbitration in writing, the parties will attempt to agree on the arbitrator and, if desired, an arbitration administrator. No particular commercial administrator is required. If the parties cannot agree or the selection process fails, either may ask a court with jurisdiction to appoint an arbitrator under 9 U.S.C. § 5.

The parties may agree on appropriate consumer arbitration rules. If they cannot, the arbitrator will establish fair procedures consistent with this agreement and applicable law, giving each party reasonable notice, an opportunity to present evidence, access to information reasonably needed to prove its case, and the right to be represented by counsel. The arbitrator must apply applicable substantive law, respect privileges, and issue a written, reasoned decision. All individual remedies and statutory attorney-fee awards available under applicable law remain available.

At your choice, hearings will take place remotely or in the county where you live, unless both sides agree otherwise. We will pay arbitration-administration and arbitrator fees above the filing fee you would pay to bring the same individual claim in your local court. If that remaining fee would prevent you from bringing a claim, we will pay it as well. Each side bears its own legal expenses except where applicable law or the arbitrator’s lawful award provides otherwise. We will not seek our attorney fees merely because you do not prevail.

A court, rather than the arbitrator, decides disputes about formation, validity, enforceability, or scope of this arbitration agreement, including the class-action waiver. Courts may enter judgment on the award, subject to the review permitted by law.

Individual proceedings

Covered claims must be brought in an individual capacity. The arbitrator may not combine unrelated claimants’ cases or conduct a class, collective, or representative proceeding without both parties’ written agreement. This does not limit remedies or proceedings that cannot legally be waived.

Exceptions and protected rights

Either party may bring an eligible individual claim in small-claims court instead of arbitration. Either may seek temporary court relief to protect intellectual property or prevent imminent harm while arbitrable merits are resolved. You may contact or file a complaint with a government agency. Claims and requests for public injunctive relief that applicable law requires a court to decide remain in court.

If a court finds part of this section unenforceable, it will be severed only to the extent necessary. If the individual-proceedings restriction cannot be enforced for a particular claim or remedy, that claim or remedy proceeds in court rather than class arbitration; the remaining enforceable agreement continues to apply. No severance may remove a nonwaivable consumer protection.

Your 30-day right to opt out

You may reject this entire arbitration section by emailing support@theaffirmations.app with the subject “Affirmations arbitration opt-out” within 30 days after first accepting these Terms. Include your name, contact email, the date you first accepted, and a clear statement that you opt out. If available, include a store order number to help identify a purchase; a purchase is not required to opt out. Keep a copy of your sent message. No fee applies, and opting out does not affect your access or the other Terms.

A material future change to this arbitration section requires the notice and assent required by law and will include a new 30-day opportunity to reject that change. Changes do not apply retroactively to a dispute already notified or a claim already filed.

13. Governing law and courts

Except for the arbitration agreement’s application of federal law, these Terms are governed by Arizona law without its conflict-of-laws rules, subject to the mandatory protections of your place of residence. For disputes properly heard in court, the courts with jurisdiction in Arizona are the agreed forum unless applicable consumer law permits you to use courts where you live, or these Terms permit a local small-claims action.

For consumers outside the United States, Section 12 does not apply. You retain any right under mandatory local law to bring a claim in your country of residence and to rely on that country’s consumer protections.

14. Suspension and termination

You may stop using the Services at any time. Cancel a paid subscription separately through your store. We may restrict or end access when reasonably necessary to address a material breach, unlawful use, fraud, or a security threat. Where appropriate and required by law, we will provide notice and an opportunity to resolve the issue. Any mandatory refund or other remedy remains available.

Provisions intended to continue after use ends, including intellectual-property rights, accrued payment obligations, liability provisions, and dispute-resolution terms, survive to the extent legally enforceable.

15. Changes and general provisions

We may revise these Terms. The date at the top identifies this version. Material changes will be accompanied by reasonable notice and any acceptance required by law before they apply. Changes will not remove accrued rights or apply retroactively to an existing dispute. If you do not agree to a change, you may stop using the Services and cancel renewal, while keeping any mandatory rights relating to an existing purchase. Arbitration changes follow Section 12.

These Terms and the applicable purchase terms form the agreement concerning our Services, subject to the applicable store license and mandatory law. If a provision is unenforceable, the remaining provisions continue, except as Section 12 specifically provides. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent except where law permits. We may transfer it as part of a lawful business reorganization or sale only if doing so does not reduce your mandatory rights. No person receives third-party rights except as required by applicable law or the controlling store license.
